Official Rules and Regulations

This raffle is conducted by Work. Live. Play. Give. Foundation (“WLPG”), a private non-profit organization under North Carolina Law. By purchasing a raffle ticket, you will be bound by the following rules:

Raffle tickets are available for purchase at www.WorkLivePlay.org. The purchase price for one raffle ticket is $10.00.

All entry purchases are final and non-refundable.

ELIGIBILITY: The raffle is open only to verifiable legal residents of the 50 United States and the District of Columbia, who are 18 years of age or older.

All proceeds from the raffle ticket sales must be received by WLPG no later than 11:59 p.m. Eastern Standard Time, Sunday, December 17, 2017. If received after the official deadline, all monies will be returned to Entrant(s) and all associated tickets will be invalid.

The winners of the raffle will be determined by random drawing. The drawing will take place on Monday, December 18, 2017, at approximately 12:00 noon Eastern Standard Time at the WLPG offices at 7208 Falls of Neuse Rd, Suite 201, Raleigh, NC. Winners will be contacted via email; this information will also be announced on the event’s website at www.WorkLivePlayGive.org. In order to collect his or her prize, a raffle ticket winner may be required to sign and deliver to WLPG : (a) a sworn affidavit of eligibility in accordance with these official rules and applicable law, including without limitation that he or she is at least 18 years old at the time he or she entered to win the winning raffle ticket; (b) such written information as is required by any applicable tax and/or real estate laws, including without limitation his or her Social Security Number; (c) proof of identity in forms satisfactory to WLPG showing that the person claiming the prize is the same person who is named on the winning raffle ticket; and (d) the winning raffle ticket stub.

Winners are responsible for any and all federal, state, and local income or excise taxes, fees, assessments and like charges associated with the prize. All personal income taxes, sales or use taxes, or any other taxes whatsoever are the sole responsibility of the winners.

Prize includes the play home and all attachments and decorations, if any, attached or set up as display with the play home.

DELIVERY: WLPG will make curbside delivery of play homes within a 50 mile radius of the display location. Play home delivery exceeding a 50 mile radius of the display location will result in a fee of $200 per 50 mile increment or portion thereof. Winners must be present for delivery. WLPG will coordinate logistics pertaining to removal of play homes from display locations. WLPG is not responsible for prize utility, quality, or otherwise.

LIMITATION, LIABILITY AND DISCLAIMERS: The decision of WLPG relating to the winner, the interpretation of the Official Rules and other matters related to this Raffle are final. THE PRIZE WILL BE DELIVERED “AS IS, WHERE IS, WITH ALL FAULTS.” WLPG MAKES NO WARRANTY OF ANY NATURE WITH RESPECT TO THE RAFFLE OR THE PRIZE, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUALITY OR NON-INFRINGEMENT. ENTRANTS HEREBY ACKNOWLEDGE THAT, EXCEPT AS SPECIFICALLY SET FORTH HEREIN, WLPG HAS NOT MADE ANY WARRANTY AND DISCLAIMS ALL LIABILITY FOR ANY WARRANTY OR LIABILITY RELATING TO THE RAFFLE, THE DRAWING, TRANSPORTATION, AND USE OF THE PRIZE WHETHER IN LAW OR FACT, CONTRACT OR TORT. All entrants, by entering this raffle, (i) agree to be bound by these official rules, and (ii) THAT THEIR NAMES AND/OR LIKENESSES MAY BE DISCLOSED TO AND USED BY THE NEWS MEDIA AND MAY OTHERWISE BE USED BY WLPG FOR PUBLICITY PURPOSES AND IN LISTS OF PRIZE WINNERS TO BE PUBLISHED IN NEWSPAPERS AND ANNOUNCED ON THE WLPG WEBSITE WITHOUT ADDITIONAL COMPENSATION OR CONSIDERATION, AND WITHOUT NOTIFICATION, REVIEW OR APPROVAL. By accepting the prize, the winner agrees to release, defend and indemnify WLPG, its directors, employees, agents, officers and all others participating with WLPG in the promotion of the raffle, from any and all liability, loss or personal or property damage, including personal injury or death, arising out of or related to, directly or indirectly, the awarding, receipt, accepting, delivery, transporting, using or misusing of the prize and participation in any prize-related activity. WLPG reserves the right to withdraw from any promotion at any time. Renderings of play homes are for representational purposes only.

A RAFFLE PARTICIPANT’S SOLE AND EXCLUSIVE REMEDY FOR ANY BREACH BY WLPG SHALL BE LIMITED TO THE RETURN OF THE DONATION FOR HIS OR HER RAFFLE TICKETS. IN NO EVENT SHALL WLPG, ITS DIRECTORS, OFFICERS, AGENTS OR REPRESENTATIVES BE LIABLE TO ANY PARTY FOR ANY LOSS OR INJURIES TO EARNINGS, PROFITS OR GOODWILL, OR FOR ANY INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES OF ANY PERSON OR ENTITY WHETHER ARISING IN CONTRACT, TORT OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

PROCEEDS: All proceeds benefit Duke Children’s Hospital and YMCA of the Triangle.

Winners of the raffle must claim their prize within 48 hours upon email notification. A second drawing will be held for unclaimed play homes on December 20, 2017 at 12:00 noon at the WLPG offices at 7208 Falls of Neuse Rd, Suite 201, Raleigh, NC. Winners will be notified by email and this information will also be announced on the event’s website at www.WorkLivePlayGive.org. Any play homes unclaimed within 48 hours of the second drawing will be donated by WLPG at its discretion.

Winners must coordinate with WLPG for play home removal from the display property no later than 10:00 am, December 29, 2017. Otherwise WLPG will make arrangements to remove it at sole winner’s cost and store it for 14 days. If the winner does not claim the prize within 14 days after removal from the display location, the prize will be forfeited. WLPG will not be responsible for land preparation or any costs related to the disposition, placement, or relocation of the prize on behalf of the winner.

Any and all disputes or claims related to the matters addressed herein shall be settled by arbitration in Raleigh, North Carolina, administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrator may be entered in the superior court for the County of Wake, North Carolina, which shall have exclusive jurisdiction thereof. Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Raffle but in no event attorneys’ fees. Under no circumstances will a raffle participant be permitted to obtain an award for, and all participants hereby waive all rights to claim, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses.
